16 AGs call on lawmakers to pass E15 legislation

A group of 16 state attorneys general (AGs), let by Iowa Attorney General Brenna Bird, on March 6 sent a letter to Congressional leadership asking lawmakers to pass the Nationwide Consumer and Fuel Retailer Choice Act of 2025. The bipartisan legislation aims to allow year-round sales of E15 nationwide.

The letter references President Donald Trump’s executive orders declaring an energy emergency and establishing the National Energy Dominance Council, which address the potential of biofuels and E15 to expand the U.S. energy supply.  

“Congress also plays a vital role in making that future a reality,” the AGs wrote. “And one major component in ensuring America’s energy production is unleashed is ensuring the availability of year-round E15 gasoline through legislation. The certainty that such legislation creates will help all liquid fuel producers. The key here is that the undersigned Attorneys General recognize that this permanent fix will ensure continued growth and certainty in planning for both renewable fuels like ethanol as well as for refiners and oil producers.

“Right now, eight States are entitled to year-round E15,” they continued. “But that creates difficulties for refiners and oil producers that must produce two products—one for year-round E15 States and another for those States that are left out. On the energy-producer and liquid fuels front, everyone can row in the same direction: year-round E15 creates certainty that allows for planning and strategic growth. Enacting nationwide year-round E15 in Congress avoids the need for temporary emergency measures or even further rulemaking from EPA.”

The letter notes that the Nationwide Consumer and Fuel Retailer Choice Act has been endorsed by a wide variety of ethanol, ag and oil groups, including the American Petroleum Institute, Renewable Fuels Association, Growth Energy, National Corn Growers Association, National Farmers Union and the National Association of Convenience Stores.

In addition to Iowa, the letter is signed by the AGs of Alabama, Alaska, Florida, Georgia, Indiana, Kansas, Louisiana, Missouri, Nebraska, North Dakota, Ohio, Pennsylvania, South Carolina, South Dakota, and West Virginia.

President Trump wants E15, and we have bipartisan, bicameral support in Congress to get this over the finish line before the summer driving season.
